These Terms of Use ("Terms") govern your use of the Talking Stories mobile application and related services (the "Services") operated by Cem Adiloglu ("we", "us", "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By creating an account or using the Services, you confirm that:

You are at least 17 years of age
You have the legal capacity to enter into these Terms
You will comply with these Terms and all applicable laws

2. Description of Services

Talking Stories is an AI-powered character chat application that allows you to:

Engage in conversations with AI characters
Create your own AI characters
Participate in goal-oriented chat scenarios
Purchase energy to continue conversations

The Services are provided for entertainment purposes only. AI characters are fictional and their responses are generated by artificial intelligence.

3. Account Registration

3.1 Account Creation

To use the Services, you must create an account using:

Email and password, or
Google Sign-In, or
Apple Sign-In

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

3.3 Account Accuracy

You agree to provide accurate and complete information and to keep it updated.

4. User Conduct

4.1 Prohibited Activities

You agree NOT to:

Use the Services if you are under 17 years of age
Impersonate any person or entity
Harass, abuse, or harm others
Upload illegal, harmful, or offensive content
Attempt to exploit, harm, or manipulate AI systems
Use the Services for illegal purposes
Attempt to reverse engineer or hack the Services
Use automated systems or bots
Violate any applicable laws or regulations

4.2 Content Standards

When creating characters or engaging in conversations, you must not include:

Content that sexualizes minors
Content promoting violence or terrorism
Hate speech or discrimination
Personal information of real individuals without consent
Content that violates intellectual property rights

4.3 Enforcement

We reserve the right to:

Remove content that violates these Terms
Suspend or terminate accounts for violations
Report illegal activity to authorities

5. User-Generated Content

5.1 Your Content

You retain ownership of characters and content you create. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to:

Host and display your content
Use it to provide the Services
Create derivative works for service improvement

5.2 Responsibility

You are solely responsible for your content and its legality.

5.3 Removal

We may remove content that violates these Terms without notice.

6. AI-Generated Content

6.1 Nature of AI Responses

AI character responses are generated by artificial intelligence and:

Are fictional and for entertainment only
Do not represent our views or opinions
May occasionally be inaccurate or inappropriate
Should not be relied upon for advice (medical, legal, financial, etc.)

6.2 No Guarantee

We do not warrant that AI responses will be:

Accurate or truthful
Appropriate for all audiences
Free from errors or bias

6.3 Your Responsibility

You acknowledge that you use AI-generated content at your own risk.

7. Energy and Purchases

7.1 Energy System

The Services use an "energy" system for conversations
Each message costs 1 energy; hints cost 2 energy
You receive 20 free energy daily, resetting at midnight UTC
Additional energy can be purchased

7.2 In-App Purchases

Purchases are processed by Apple App Store or Google Play
All purchases are final and non-refundable, except as required by law
Purchased energy never expires

7.3 Refunds

Refund requests must be directed to Apple or Google according to their refund policies.

7.4 Price Changes

We reserve the right to modify pricing at any time. Existing purchases are not affected.

8. Intellectual Property

8.1 Our Property

The Services, including but not limited to:

App design and interface
Official characters
Logos and branding
Software and technology

are owned by us and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.

8.3 Restrictions

You may not:

Copy, modify, or distribute the Services
Use our trademarks without permission
Remove any copyright notices

8.4 Copyright Complaints

If you believe content on the Services infringes your copyright, please contact us at [email protected] with:

A description of the copyrighted work you claim has been infringed
The location of the allegedly infringing content within the Services
Your contact information (name, email, phone number)
A statement that you have a good faith belief that the use is not authorized
A statement that the information you provide is accurate

We will investigate and take appropriate action.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers

10.1 "As Is" Basis

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10.2 No Warranties

We do not warrant that:

The Services will be uninterrupted or error-free
Defects will be corrected
The Services are free from viruses or harmful components

10.3 AI Limitations

We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, or consequential damages
Loss of profits, data, or goodwill
Damages arising from your use of the Services

11.2 Maximum Liability

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

11.3 Exceptions

Some jurisdictions do not allow limitation of liability. In such cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your use of the Services
Your violation of these Terms
Your violation of any third-party rights
Content you create or submit

13. Account Termination

13.1 By You

You may delete your account at any time through the app settings. Upon deletion:

Your data becomes immediately inaccessible
After 30 days, your data is permanently deleted

13.2 By Us

We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Pose a risk to other users or the Services

13.3 Effect of Termination

Upon termination:

Your license to use the Services ends
You lose access to your account and content
Purchased energy is forfeited (except where prohibited by law)

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Posting updated Terms in the app
Updating the "Last Updated" date
Sending a notification for significant changes

Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Turkey. Any disputes will be resolved through good faith negotiation first. If we cannot resolve a dispute informally, you agree to resolve it through the courts in Turkey.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16.3 Waiver

Our failure to enforce any right does not constitute a waiver.

16.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
